# Terms of Service

These Terms of Service govern your access to and use of Xignal, including its website, game interface, applications, smart contract integrations, Marketplace, digital assets, community features, documentation, and related services.

In these Terms, “Xignal,” “we,” “us,” and “our” refer to Xignal. “User,” “you,” and “your” refer to any person accessing or using Xignal.

Please read these Terms carefully before using Xignal. By accessing the website, connecting a wallet, creating a profile, initiating an Operation, crafting or acquiring an asset, using the Marketplace, interacting with a supported smart contract, or otherwise using Xignal, you confirm that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you must not access or use Xignal.

### About Xignal

Xignal is an interactive blockchain-based game in which users build and develop an AI system, configure an X-Core, install AI Hardwares, complete Operations, generate game resources, improve Skills, craft hardware, participate in a player-driven Marketplace, assemble Xignals, and progress through Network Layers.

Certain game assets and transactions may be recorded on supported public blockchain networks. Xignal may provide an interface that enables users to interact with blockchain smart contracts, non-custodial wallets, digital assets, and third-party infrastructure.

Xignal is provided primarily as an entertainment product. References to resources, rewards, rarity, ownership, trading, Marketplace value, or economic activity describe game functionality and do not constitute financial, investment, legal, accounting, or tax advice.

Nothing contained in Xignal, its documentation, website, social media accounts, community channels, announcements, or related materials is an offer, solicitation, recommendation, guarantee, or promise that any digital asset will increase in value, remain liquid, generate income, or produce a financial return.

### Eligibility

You may use Xignal only if you are legally capable of entering into a binding agreement and your use of the service is permitted under the laws applicable to you.

You must meet the minimum legal age required in your jurisdiction. Where you are not legally permitted to enter into these Terms independently, you may use Xignal only with the valid authorisation and supervision of a parent or legal guardian, provided that such use is permitted by applicable law.

You may not access or use Xignal if you are located in, ordinarily resident in, or acting on behalf of a person or entity located in a jurisdiction where access to the service, blockchain functionality, digital assets, or related transactions is prohibited.

You may not use Xignal if you are subject to applicable trade, financial, economic, or sanctions restrictions, or if your use would cause Xignal or any service provider to violate applicable law.

We may introduce geographic restrictions, age checks, sanctions screening, wallet screening, identity verification, transaction limits, or other eligibility measures where reasonably necessary for legal, regulatory, security, or operational reasons.

By using Xignal, you represent that the information and confirmations you provide are accurate and that you satisfy all applicable eligibility requirements.

### Changes to These Terms

We may update these Terms when Xignal’s features, game economy, legal structure, technology, supported networks, service providers, security procedures, or regulatory obligations change.

The current version will display a revised “Last updated” date.

Where a change materially affects users’ legal rights or obligations, we may provide additional notice through the website, game interface, email, documentation, or another appropriate communication channel.

Unless applicable law requires otherwise, updated Terms become effective when published or on the date stated in the notice.

Continued use of Xignal after updated Terms become effective constitutes acceptance of those Terms. If you do not agree to an update, you must stop using Xignal.

### Wallet Connection and Authentication

Xignal may allow users to access features by connecting a compatible blockchain wallet.

Your wallet is provided by you or by an independent third-party wallet provider. Unless expressly stated otherwise, Xignal does not create, operate, control, or hold custody of your wallet.

Xignal does not request, collect, or store private keys or seed phrases. You must never disclose a private key or seed phrase to Xignal, its team, moderators, support representatives, or anyone claiming to act on behalf of the project.

Wallet authentication may require you to sign a message. Signing an authentication message may confirm control over a wallet address but does not transfer ownership of the wallet or its assets to Xignal.

You are solely responsible for ensuring that you connect the correct wallet, select the correct network, review every transaction request, and understand the permissions granted through a digital signature or token approval.

### Account and Profile Responsibility

Where Xignal provides accounts or profiles, you are responsible for keeping all associated information accurate and secure.

You may not impersonate another person, misrepresent your affiliation with an organisation, use a misleading identity, or create a profile designed to deceive other users.

You are responsible for all activity conducted through your account, profile, connected wallet, device, or credentials, except where applicable law assigns responsibility differently.

You must notify us promptly if you become aware of unauthorised access, account compromise, fraudulent activity, or a security issue affecting your use of Xignal.

We may require reasonable verification before changing profile information, responding to an account request, or assisting with a wallet-associated issue.

### Non-Custodial Service

Unless a specific feature expressly states otherwise, Xignal operates as a non-custodial service.

You retain control of the digital assets held in your wallet. Xignal does not hold your private keys and generally cannot access, transfer, freeze, recover, return, or restore assets held through your wallet.

Xignal cannot recover access to a lost wallet, restore a seed phrase, reverse a transaction, change a destination address, or return assets transferred to an incorrect or unsupported address.

You are solely responsible for securing your wallet, private keys, seed phrase, passwords, devices, browser extensions, authentication methods, and backup information.

Loss or compromise of wallet credentials may result in permanent loss of access to your digital assets.

### Blockchain Transactions

Blockchain transactions are processed by independent decentralised networks and not directly by Xignal.

When you initiate a transaction, it may be broadcast to a public blockchain and processed by validators, sequencers, node operators, or other independent network participants.

A confirmed blockchain transaction may be permanent and irreversible. Xignal cannot guarantee that a transaction can be cancelled, modified, accelerated, reversed, or recovered.

You are responsible for checking the destination address, selected network, asset type, transaction amount, contract address, approval permissions, gas fee, and all other transaction details before confirming a transaction.

Transactions may fail, remain pending, be delayed, or execute differently than expected because of network congestion, insufficient gas, RPC failures, smart contract behaviour, slippage, blockchain reorganisations, forks, validator issues, sequencer outages, or other technical conditions.

Any transaction displayed as pending or estimated within the Xignal interface is not guaranteed to complete.

### Network and Transaction Fees

Use of supported blockchain networks may require payment of gas fees or other network charges.

These fees are determined by the relevant blockchain or third-party infrastructure and are generally paid directly from the user’s wallet.

Unless expressly stated otherwise, gas fees are not charged, received, or controlled by Xignal.

Network fees may change rapidly and may be payable even where a transaction fails or does not produce the result expected by the user.

Xignal is not responsible for reimbursing gas fees, failed transaction costs, bridge fees, wallet fees, exchange fees, or third-party service charges unless reimbursement is expressly required by applicable law.

### Game Access and Licence

Subject to your compliance with these Terms, Xignal grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable licence to access and use the service for lawful personal entertainment purposes.

This licence does not transfer ownership of Xignal, its software, content, systems, brand, documentation, game mechanics, artwork, interfaces, databases, or intellectual property.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, disassemble, scrape, mirror, frame, reproduce, or commercially exploit any part of Xignal except where expressly permitted by us or by mandatory law.

You may not use Xignal’s name, logo, artwork, characters, visual identity, documentation, code, or other proprietary materials in a manner that suggests endorsement, partnership, or official affiliation without prior written permission.

### Game Resources

Xignal may include game resources such as $XIGN, Insights, Components, Xignal Fragments, progression points, rewards, bonuses, access rights, or other units used within the game.

The name, classification, utility, availability, transferability, and technical implementation of a resource may depend on the current version of the game.

A game resource may exist solely within Xignal’s controlled systems, may be represented by a blockchain token, or may combine on-chain and off-chain functionality.

Unless expressly stated otherwise, off-chain resources do not represent stored monetary value, legal tender, electronic money, bank deposits, ownership interests, or claims against Xignal.

Game resources may not be redeemable for fiat currency, cryptocurrency, goods, services, or other consideration.

We may change generation rates, uses, requirements, limits, denominations, conversion mechanics, or availability of game resources where reasonably necessary to maintain balance, security, sustainability, compliance, or gameplay quality.

### Digital Assets

Xignal may support blockchain-based assets representing AI Hardwares, Xignals, hardware, cosmetic items, access rights, achievements, or other game-related content.

Ownership of a blockchain token generally means control of the token through the wallet in which it is held. It does not grant ownership of Xignal, the Xignal company, the development team, the underlying software, or any associated business.

Holding a digital asset does not grant equity, dividends, profit-sharing rights, voting rights, governance authority, intellectual property ownership, revenue rights, or any other corporate or financial entitlement unless such a right is expressly and lawfully stated in a separate binding agreement.

A digital asset may provide functionality within Xignal, but its utility may depend on the current game version, supported network, smart contract, technical infrastructure, legal requirements, and continued operation of the relevant feature.

Ownership of an asset does not guarantee permanent support, permanent display, permanent interoperability, future rewards, access to every feature, or preservation of any particular utility.

### Licence to Associated Content

A digital asset may be linked to artwork, metadata, animation, audio, text, statistics, or other content.

Unless separate asset-specific terms state otherwise, ownership of the token does not transfer ownership of the associated intellectual property.

Subject to compliance with these Terms, Xignal may grant the lawful holder of a supported asset a limited, personal, non-exclusive, revocable, and non-transferable licence to display and use the associated content for personal and non-commercial purposes.

This licence does not permit the holder to claim authorship, register confusingly similar intellectual property, use Xignal branding without permission, create misleading derivative products, or use the content for unlawful, deceptive, hateful, infringing, or harmful purposes.

The licence may end when the holder transfers the relevant asset, ceases to lawfully control it, or materially violates these Terms.

### AI Builds and Gameplay Progression

Users may configure an AI Build by combining an X-Core, AI Hardwares, Skills, Expansion Grid capacity, Energy Capacity, and other available game systems.

An AI Build is determined by the current configuration and state of the relevant game assets and progression data.

Xignal does not guarantee that a specific configuration will remain optimal, produce a particular reward, maintain the same performance, or retain the same gameplay advantage after balancing updates.

Skills, Hardwares, Operations, crafting results, repair requirements, resource costs, reward rates, Network Layers, and other mechanics may be modified to improve game balance, prevent exploitation, maintain economic stability, or support future development.

Progression recorded off-chain may depend on Xignal’s infrastructure and may not be transferable independently of the service.

### Operations and Rewards

Xignal may allow users to complete Research, Analysis, Engineering, and other Operations.

Operations may consume game resources, require specific Hardwares, take time to complete, and produce variable results.

Displayed reward probabilities, estimated completion times, potential outputs, rarity rates, and performance values may be rounded, approximate, or subject to technical and balancing conditions.

A displayed potential reward is not a guarantee that the user will receive that reward.

Randomised or probability-based gameplay outcomes are determined by the mechanics applicable at the time the action is processed. Results may vary between users and between separate attempts.

We may cancel, recalculate, withhold, or reverse off-chain rewards obtained through an error, exploit, unauthorised automation, manipulation, duplicate transaction, or violation of these Terms.

Where an asset has already been permanently transferred through a public blockchain, our ability to reverse or recover it may be limited or nonexistent.

### Workshop and Crafting

The Workshop may allow users to spend resources to craft AI Hardwares, repair equipment, improve infrastructure, or complete other production actions.

Crafting may involve variable outcomes, rarity probabilities, resource consumption, time requirements, and smart contract transactions.

Once a crafting action or blockchain transaction is confirmed, consumed resources may not be recoverable.

The appearance, statistics, compatibility, rarity, Energy requirements, Runtime, and functionality of crafted assets may change as part of legitimate balancing or technical updates.

Xignal does not guarantee that a crafted item will have a particular secondary-market value or remain desirable to other users.

### Xignal Assembly and Network Layers

Users may collect resources and Xignal Fragments to assemble a Xignal and unlock access to additional Network Layers.

Assembly requirements, availability, limits, processing times, and resulting benefits may change as Xignal develops.

Completing an assembly does not guarantee access to every current or future feature.

Network Layers may be introduced, changed, reorganised, restricted, merged, suspended, or removed for balancing, technical, security, commercial, or legal reasons.

Roadmaps, previews, planned Network Layers, and future utilities are expressions of current development intentions and are not binding commitments.

### Marketplace

Xignal may provide an interface through which users can list, discover, acquire, sell, or transfer supported digital assets.

Unless expressly stated otherwise, transactions occur directly between users or through blockchain smart contracts.

Xignal is not the owner, seller, buyer, guarantor, broker, fiduciary, trustee, custodian, or agent of users participating in Marketplace transactions.

Users are responsible for independently evaluating every asset, collection, wallet, listing, contract, price, creator, and counterparty before completing a transaction.

Marketplace information may be incomplete, inaccurate, delayed, fraudulent, or manipulated. Asset names, images, descriptions, metadata, rarity claims, ownership histories, and creator identities may be copied or misrepresented by third parties.

Displaying an asset or listing does not constitute verification, endorsement, recommendation, certification, or guarantee by Xignal.

We may hide, restrict, disable, or remove access through our interface to assets, listings, collections, or accounts associated with fraud, theft, sanctions, intellectual property infringement, technical risk, prohibited content, or suspected violations.

Removing an item from the Xignal interface does not necessarily remove the token or transaction record from a public blockchain.

### Marketplace Fees

Xignal may charge fees for Marketplace transactions, crafting, minting, assembly, repairs, upgrades, entry, or other features.

Applicable fees will normally be displayed before the user confirms the relevant action.

Fees may vary by feature, network, asset, campaign, user category, or service version.

We may change fees prospectively by updating the interface, documentation, smart contracts, or these Terms.

Transaction fees charged by Xignal are separate from gas fees, wallet fees, bridge fees, exchange fees, payment-provider fees, or other third-party charges.

Unless required by applicable law, completed service fees are non-refundable once the relevant transaction, mint, crafting action, or digital service has been initiated or completed.

### Prices and Asset Value

Xignal does not determine, maintain, support, stabilise, or guarantee the price of any digital asset.

Prices displayed through Xignal may be supplied by users, smart contracts, marketplaces, pricing services, liquidity venues, or other third parties.

Displayed prices may be delayed, approximate, unavailable, or different from the amount ultimately received in a transaction.

The market value of $XIGN, AI Hardwares, Xignals, or any other supported asset may increase, decrease, fluctuate significantly, or fall to zero.

Xignal has no obligation to purchase assets from users, provide liquidity, create a secondary market, maintain trading volume, support any price level, or compensate users for a decline in value.

You may be unable to sell, transfer, exchange, or use an asset at the time or price you expect.

### No Investment Relationship

Xignal is not your financial adviser, broker, investment manager, trustee, fiduciary, agent, or tax adviser.

No communication from Xignal should be interpreted as personalised financial, investment, legal, accounting, or tax advice.

You are solely responsible for determining whether acquiring, holding, using, transferring, or selling a digital asset is appropriate for your circumstances.

You should obtain independent professional advice where necessary.

You must not participate using money or assets that you cannot afford to lose.

### User Conduct

You may use Xignal only for lawful purposes and in accordance with these Terms.

You must not use Xignal to commit fraud, launder money, evade sanctions, finance unlawful activity, manipulate markets, deceive users, infringe intellectual property, distribute malware, attack systems, steal assets, or violate the rights of another person.

You must not exploit bugs, vulnerabilities, smart contract errors, pricing errors, reward calculation errors, duplicate transaction behaviour, or unintended game mechanics.

You must not use bots, scripts, automation, account farms, unauthorised software, artificial traffic, transaction manipulation, or coordinated activity to gain an unfair advantage, claim rewards, distort rankings, manipulate the Marketplace, or interfere with normal gameplay.

You must not attempt to bypass access restrictions, geographic limits, eligibility requirements, security controls, rate limits, wallet screening, anti-fraud systems, or other protective measures.

You must not interfere with Xignal’s servers, smart contracts, interfaces, APIs, databases, networks, or service providers.

You must not use deceptive links, impersonate Xignal personnel, operate fraudulent support channels, request seed phrases, distribute fake tokens, or create misleading assets that appear officially connected to Xignal.

You must not use Xignal to transmit unlawful, abusive, threatening, defamatory, discriminatory, obscene, deceptive, or infringing content.

### Exploits and Unintended Behaviour

A game mechanic, transaction result, reward, or interface behaviour may occasionally function differently from its intended design.

The existence of a technical possibility does not mean that the behaviour is authorised.

If you discover an apparent vulnerability, exploit, duplicate reward, pricing error, or unintended outcome, you must stop using it and report it through emeil.

We may investigate suspicious activity, pause affected features, restrict access, correct off-chain balances, remove improperly obtained rewards, and take other reasonable steps to protect users and the ecosystem.

Where permitted by law, we may suspend or terminate users who knowingly exploit errors or conceal abusive activity.

### User Content

Xignal may allow users to submit usernames, profile images, descriptions, messages, feedback, links, artwork, listings, or other content.

You retain ownership of content that you lawfully own.

By submitting content to Xignal, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, display, format, adapt, distribute, and use that content only as reasonably necessary to operate, promote, secure, and improve Xignal.

You represent that you have the rights required to submit the content and that its use by Xignal will not violate another person’s intellectual property, privacy, publicity, contractual, or other rights.

We may remove or restrict content that violates these Terms, applicable law, third-party rights, platform security, or community standards.

### Intellectual Property

Xignal and all related software, smart contract interfaces, artwork, designs, graphics, animations, audio, text, documentation, databases, game mechanics, names, logos, trademarks, and other content are owned by or licensed to Xignal, except for content clearly identified as belonging to users or third parties.

These Terms do not transfer any intellectual property rights to users except for the limited access and content licences expressly described.

Feedback, suggestions, concepts, or improvement ideas voluntarily provided to Xignal may be used without restriction or compensation, provided that such use does not unlawfully disclose personal or confidential information.

### Copyright and Intellectual Property Complaints

If you believe content accessible through Xignal infringes your copyright, trademark, or other intellectual property rights, you may submit a notice to emeil.

The notice should identify the protected work, the allegedly infringing material, its location, your contact information, the basis of your claim, and any legally required declarations.

We may request additional information before acting on a complaint.

Where appropriate, we may restrict access to disputed material through our interface, notify the relevant user, or take other measures required by law.

Xignal may not be able to delete a token, transaction, or metadata permanently stored on a public blockchain or third-party decentralised storage network.

### Third-Party Services

Xignal may integrate with wallets, blockchains, bridges, exchanges, marketplaces, payment providers, RPC services, node operators, analytics platforms, social networks, community services, storage providers, and other third-party products.

Third-party services are operated independently and are governed by their own terms, policies, fees, and technical conditions.

Xignal does not control and does not guarantee the security, availability, performance, legality, accuracy, or continued operation of third-party services.

A link, integration, or supported connection does not constitute endorsement or acceptance of responsibility for the third party.

You use third-party services at your own risk.

### Service Availability

We aim to provide a reliable service but do not guarantee that Xignal will always be available, secure, complete, uninterrupted, or error-free.

Xignal may be unavailable because of maintenance, updates, traffic, technical failures, cyberattacks, smart contract incidents, blockchain congestion, network outages, third-party failures, legal requirements, force majeure events, or other circumstances.

We may modify, pause, restrict, migrate, replace, or discontinue any feature, asset integration, blockchain network, smart contract, Marketplace function, Operation, reward system, or part of Xignal.

Where reasonably possible, we may provide advance notice of material planned changes, but advance notice may not be possible during emergencies, security incidents, legal restrictions, or technical failures.

### Updates and Game Balancing

Xignal is an evolving game.

We may update game rules, statistics, resources, Skills, Hardwares, Energy costs, Runtime, crafting requirements, repair systems, Operation durations, reward rates, rarity probabilities, Marketplace fees, Xignal Assembly requirements, Network Layers, progression limits, and other mechanics.

Updates may affect the utility, scarcity, desirability, compatibility, or market value of digital assets.

Asset ownership does not create a contractual right to unchanged mechanics, permanent utility, specific performance, future rewards, or compensation after a balancing update.

We will not intentionally alter blockchain ownership records under user control, but we may change how an asset is recognised, displayed, or used within Xignal where permitted by applicable law.

### Suspension and Termination

We may restrict, suspend, or terminate access to Xignal where we reasonably believe that a user has violated these Terms, created a security risk, engaged in fraud, exploited the game, infringed another person’s rights, used prohibited automation, become legally ineligible, or exposed Xignal or other users to legal or operational risk.

We may also restrict access where required by law, sanctions obligations, court orders, regulatory requests, service-provider restrictions, or emergency security measures.

Where appropriate and legally permitted, we may provide notice and an opportunity to respond.

Suspension or termination may affect access to profiles, off-chain progression, rankings, rewards, communications, or interface functionality.

Because blockchain assets are controlled through user wallets, termination may not prevent a user from transferring an asset independently through a public blockchain. However, the asset may no longer be supported, displayed, or usable within Xignal.

Provisions relating to intellectual property, risk, liability, indemnification, dispute resolution, and other terms that by their nature should continue will survive termination.

### Refunds

Unless required by applicable law or expressly stated in a specific offer, blockchain transactions, minting fees, crafting costs, consumed game resources, Marketplace fees, gas fees, and completed digital services are final and non-refundable.

A user is not entitled to a refund solely because an asset decreases in value, becomes less desirable, receives adjusted game statistics, loses Marketplace liquidity, or is affected by a game balancing update.

Where mandatory consumer law provides a right of withdrawal, refund, repair, replacement, price reduction, or other remedy, those rights will remain available to the extent required by law.

Where digital content or a digital service begins immediately at the user’s request, Xignal may request any consent or acknowledgement required by law regarding the commencement of performance and any resulting effect on a statutory withdrawal right.

### Taxes

You are solely responsible for determining whether taxes, duties, reporting obligations, or other governmental charges apply to your use of Xignal.

Tax consequences may arise from acquiring, receiving, crafting, holding, selling, exchanging, transferring, or disposing of digital assets or rewards.

Xignal does not provide tax advice and does not guarantee that transaction histories, receipts, blockchain records, or reports will satisfy your legal obligations.

You are responsible for keeping appropriate records and paying all taxes and charges for which you are liable.

### Regulatory Compliance

Blockchain games, digital assets, tokens, NFTs, marketplaces, and related services may be regulated differently across jurisdictions.

The legal treatment of a feature or asset may depend on its design, functionality, distribution, marketing, transferability, user location, service provider, and applicable law.

We may change, restrict, suspend, or discontinue features to comply with legal, regulatory, licensing, sanctions, consumer-protection, anti-money-laundering, tax, or other obligations.

We do not represent that Xignal or every feature is lawful or available in every jurisdiction.

You are responsible for ensuring that your use of Xignal complies with the laws applicable to you.

### Privacy

Our collection and use of personal information are described in the Xignal Privacy Policy.

By using Xignal, you acknowledge that blockchain transactions are generally public and may be permanently recorded on networks outside our control.

The Privacy Policy forms part of the legal framework governing the service but does not replace these Terms.

### Security

We use reasonable technical and organisational measures designed to protect Xignal.

No website, blockchain, smart contract, wallet, database, or internet service can be guaranteed to be completely secure.

You acknowledge that security incidents may occur despite reasonable precautions.

You are responsible for independently verifying official domains, contract addresses, wallet prompts, social media accounts, announcements, and support contacts.

Xignal will never request your seed phrase or private key.

### Assumption of Risk

By using Xignal, you acknowledge and accept the risks associated with blockchain technology, smart contracts, digital assets, non-custodial wallets, public networks, marketplaces, and evolving game economies.

These risks include price volatility, total loss of value, loss of wallet access, irreversible transactions, smart contract vulnerabilities, phishing, malware, theft, blockchain forks, network congestion, validator failure, sequencer failure, bridge exploits, regulatory changes, tax consequences, service interruptions, third-party failures, and changes to game utility.

You accept that digital assets may have no resale market and may be impossible to sell.

You understand that Xignal does not guarantee any price, profit, reward, liquidity, functionality, or future development.

You use Xignal voluntarily and at your own risk.

### Disclaimer of Warranties

To the maximum extent permitted by applicable law, Xignal is provided on an “as is” and “as available” basis.

We disclaim all express, implied, and statutory warranties, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, compatibility, and uninterrupted operation.

We do not warrant that Xignal will meet your expectations, that all information will be accurate, that errors will be corrected, that smart contracts will be free from vulnerabilities, that third-party services will remain available, or that any asset will retain value or utility.

Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.

### Limitation of Liability

To the fullest extent permitted by applicable law, Xignal, its founders, directors, officers, employees, developers, contractors, affiliates, licensors, service providers, representatives, and contributors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or connected with Xignal.

This includes loss of profits, revenue, opportunities, goodwill, data, account access, game progression, digital assets, token value, Marketplace value, or expected rewards.

To the fullest extent permitted by law, we are not responsible for losses caused by wallet compromise, user error, incorrect addresses, wrong networks, malicious approvals, phishing, malware, private key loss, blockchain failures, smart contract incidents, third-party services, transaction delays, failed transactions, market volatility, lack of liquidity, regulatory actions, balancing updates, service suspension, or unauthorised conduct by another user.

This limitation does not apply to liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, death or personal injury caused by negligence where applicable, or violation of mandatory consumer rights.

### Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Xignal, its affiliates, founders, directors, officers, employees, developers, contractors, licensors, representatives, and service providers from claims, liabilities, losses, damages, judgments, penalties, costs, and reasonable legal fees arising from your violation of these Terms, unlawful use of Xignal, infringement of another person’s rights, submitted content, fraudulent activity, prohibited conduct, or misuse of a connected wallet.

This obligation does not apply to the extent a claim results from conduct for which Xignal is legally responsible and liability cannot be excluded.

### Force Majeure

Xignal will not be responsible for delay, interruption, failure, or loss caused by circumstances beyond its reasonable control.

Such circumstances may include natural disasters, war, civil disorder, government action, sanctions, labour disputes, internet failures, power failures, cyberattacks, epidemics, blockchain failures, validator outages, sequencer outages, third-party infrastructure failures, cloud-service disruptions, telecommunications failures, or other force majeure events.

This provision does not limit mandatory rights that cannot legally be excluded.

### Dispute Resolution

Before initiating formal proceedings, you agree to contact email and provide a reasonable description of the dispute, the relevant wallet address or account, the requested resolution, and any supporting information.

The parties will attempt in good faith to resolve the dispute informally within 90 days after receipt of the notice.

Any arbitration agreement, class-action waiver, jury-trial waiver, or alternative dispute process should apply only if expressly added to these Terms in a form valid under the governing law and the laws applicable to the user.

Nothing in this section prevents either party from seeking urgent injunctive or protective relief from a competent court where necessary to prevent immediate harm, protect intellectual property, or address a security threat.

### Consumer Rights

Nothing in these Terms excludes, restricts, or overrides rights that cannot be waived under applicable consumer law.

Where you qualify as a consumer, you may have statutory rights relating to digital content, digital services, transparency, conformity, withdrawal, refunds, remedies, unfair contract terms, or dispute resolution.

If a provision of these Terms conflicts with mandatory consumer law, the mandatory rule will prevail to the extent of the conflict.

### No Partnership or Agency

These Terms do not create a partnership, joint venture, employment relationship, franchise, fiduciary relationship, agency, trust, brokerage relationship, or investment-management relationship between you and Xignal.

Neither party has authority to bind the other except where expressly agreed in writing.

### Assignment

You may not transfer or assign your rights or obligations under these Terms without prior written consent from Xignal.

We may transfer or assign these Terms as part of a merger, acquisition, restructuring, financing, sale of assets, transfer of the Xignal project, or reorganisation, subject to applicable law.

Any assignment does not remove mandatory rights available to users.

### Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permitted or removed to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

### No Waiver

Failure by Xignal to enforce a provision of these Terms does not waive the right to enforce that provision later.

A waiver is effective only if made in writing by an authorised representative of Xignal.

### Entire Agreement

These Terms, together with the Privacy Policy, Economy and Risk Notice, applicable asset licences, campaign rules, Marketplace terms, and any additional terms presented for a specific feature, form the entire agreement between you and Xignal regarding the service.

If additional terms conflict with these Terms, the additional terms will control only in relation to the specific feature or activity they govern, unless they state otherwise.

### Language

These Terms may be translated into other languages for convenience.

Unless mandatory law requires otherwise, the English version will control in the event of an inconsistency between translations.

### Electronic Communications

By using Xignal, you agree that notices, disclosures, transaction information, policy updates, and other communications may be provided electronically through the website, game interface, email, documentation, or official community channels.

Electronic communications satisfy any legal requirement that a communication be in writing, except where applicable law requires another format.
